Environmental Clearance & Pollution Control
Industrial establishments in India require environmental clearances and permissions before commencing operations. The Environmental Impact Assessment (EIA) Notification 2006 under the Environment Protection Act (EPA) 1986 categorises projects as Category A (central clearance), Category B1 (state clearance with EIA), and Category B2 (state clearance without EIA).
State Pollution Control Boards (SPCBs) issue Consent to Establish (CTE) before construction and Consent to Operate (CTO) before commencing production. Both must be renewed periodically. Non-compliance leads to closure orders, criminal prosecution under EPA, and penalties.
Operating without Environmental Clearance or a valid CTO is a criminal offence under Section 15 of the EPA 1986 — imprisonment up to 5 years and fine up to ₹1 lakh, with an additional ₹5,000/day for continuing violation.
Category A projects
Central clearance from MoEFCC — EIA mandatory
Category B1 projects
State SEIAA clearance — EIA required
Category B2 projects
State SEIAA clearance — No EIA required
CTE validity
Typically 5 years from issue date
CTO renewal
Before expiry — continued operation without valid CTO is illegal

How We Handle Environmental Clearance
Project Categorisation
Classify project under EIA Notification 2006 (Category A/B1/B2) based on type, investment, and sector; identify applicable regulations.
Application Preparation
Prepare Form-1, pre-feasibility report (PFR), Form-1A as applicable; document activities, raw materials, effluents, emissions, and waste streams.
EIA & Public Hearing
Coordinate with EIA consultant for baseline data and draft EIA report; represent at public hearing before SEIAA; address community concerns.
Clearance & Consent Filing
Submit EC application on Parivesh portal; CTE to State PCB; respond to SEIAA/MoEFCC expert appraisal committee queries; follow up until order.
Post-Clearance Compliance
Implement EC conditions; file six-monthly compliance reports; renew CTO before expiry; file Annual Environmental Statement (Form-V) by 30 September.
