Overview

Environmental Clearance & Pollution Control

Industrial establishments in India require environmental clearances and permissions before commencing operations. The Environmental Impact Assessment (EIA) Notification 2006 under the Environment Protection Act (EPA) 1986 categorises projects as Category A (central clearance), Category B1 (state clearance with EIA), and Category B2 (state clearance without EIA).

State Pollution Control Boards (SPCBs) issue Consent to Establish (CTE) before construction and Consent to Operate (CTO) before commencing production. Both must be renewed periodically. Non-compliance leads to closure orders, criminal prosecution under EPA, and penalties.

Operating without Environmental Clearance or a valid CTO is a criminal offence under Section 15 of the EPA 1986 — imprisonment up to 5 years and fine up to ₹1 lakh, with an additional ₹5,000/day for continuing violation.
