When Disputes Require the Courts
Litigation is the option of last resort — but when negotiation and arbitration fail, or when a creditor needs urgent interim relief to secure assets, court proceedings become necessary. JCA's litigation practice covers the full spectrum: civil courts, criminal matters, the Debt Recovery Tribunal (DRT), the National Company Law Tribunal (NCLT), the Income Tax Appellate Tribunal (ITAT), SEBI/SAT, constitutional matters before the Madras High Court, Lok Adalat, and consumer dispute forums across Tamil Nadu.
What sets JCA apart is the integration of financial expertise into every court proceeding. Money recovery suits, DRT Original Applications, NCLT insolvency petitions, and ITAT appeals all require precise quantification of financial claims — JCA's CA team provides this, while our advocates manage the proceedings. This integrated model produces stronger pleadings and more compelling evidence.
JCA files Section 9 IBC petitions on behalf of operational creditors — often triggering full payment within weeks of the Section 8 demand notice.

Our Litigation Process
Case Assessment
Analyse the facts, documents, and legal merit of the claim or defence. Advise on the most appropriate forum, strategy, and realistic outcome. Provide a frank assessment of strengths and weaknesses.
Pre-Litigation Notice
Serve a formal legal notice before filing (mandatory in many cases — especially for consumer complaints and DRT matters). Many matters settle at the notice stage without court intervention.
Pleadings Drafting
Draft the plaint (for plaintiff) or written statement (for defendant). In NCLT matters, draft the petition and supporting affidavit. All pleadings prepared with supporting documents and evidence.
Filing & Admission
File the case in the correct court or tribunal. Attend admission hearing, obtain case number, and serve the opposite party. Apply for interim relief (injunction, attachment) simultaneously where required.
Interim Proceedings
Argue interim applications for injunctions, attachment before judgment, or stay orders. Respond to the counterparty's interim applications. Secure the client's position pending final hearing.
Evidence & Witnesses
File affidavit of evidence (examination-in-chief). Cross-examine the opposing party's witnesses. Prepare documentary evidence for formal exhibit marking. Manage financial expert evidence where needed.
Arguments
Present final oral arguments. File written submissions summarising the legal and factual case. Reply to the opposing party's arguments. Cite relevant precedents and statutory provisions.
Decree & Execution
Obtain the court order or decree. Where the opposing party does not comply voluntarily, file execution proceedings — attachment of bank accounts, property, or salary — to enforce the decree.
